FitAWare Participant Privacy Policy

This Policy establishes guidelines for the collection, use and confidentiality of FitAWare Participant non-public personal information. This Policy shall apply to all non-public FitAWare Participant information obtained by AWare Technologies, and its subsidiaries and affiliates. If you are a user of the FitAWare service you are a Participant under the terms of this policy.
Terminology
"AWare" and "AWare Technologies," "we," "us", and "our" refer to AWare, Inc., a Delaware corporation, doing business as AWare Technologies in Massachusetts, with a principal place of business at 614 Massachusetts Ave, Cambridge MA. "Customers" are the businesses or other organizations who contract with AWare for the provision of the FitAWare service. "FitAWare" and the "FitAWare Service" refers to all services and reporting functionality provided through the fitaware.net domain. "Participants" are individual employees or affiliates of Customers who elect to participate in the FitAWare program or who use FitAWare reporting tools. The "Sponsoring Customer" is the organization or business that sponsors a particular Participant's FitAWare service.
"Non-public personal information" refers to any information about an individual that is not generally available in a public forum. Personal information need not be confidential or sensitive to be non-public. AWare treats your name and institutional affiliation (Sponsoring Customer affiliation) as public information that does not require prior approval to be shared with other FitAWare participants. All other Participant profile information and activity data is treated as non-public personal information and subject to the terms of this policy.
Summary
AWare Technologies collects a limited amount of non-public information about FitAWare Participants through the Customer organization purchasing the FitAWare service (the Sponsoring Customer), through any changes a Participant makes to his or her own FitAWare profile, and through the ActionTracker physical activity monitor carried by Participants. Non-public Participant information will not be sold, exchanged, transferred, or given to anyone for any reason whatsoever without prior Participant consent, except as required by law. Participants may elect to share their own activity data as measured and reported by FitAWare with other FitAWare Participants, or to publish their own activity data to Google Health or other third party services specifically authorized by the Participant.
Aggregate statistics on Participant activity data and the use of the FitAWare service are gathered by AWare Technologies and may be provided to the Sponsoring Customer so that overall levels of participation and activity may be assessed, and so that the outcomes of challenges and contests may be determined. AWare Technologies also uses these aggregate statistics for forensic purposes and to improve our products and services.
We collect information about FitAWare Participants from the following three (3) sources:

Information your business or organization (Sponsoring Customer) provides us about you when you sign up as a FitAWare Participant (such as your name, email address, employee ID, departmental affiliation, etc.),

Information you provide us through your FitAWare.net profile updates (such as your name, email address, daily step goal, etc.),

Information about your daily physical activity as measured by the AWare ActionTracker device you carry with you.
We put you in charge of your non-public information
As a FitAWare Participant, you may choose to share your FitAWare activity data with other Participants by "friending" them. If you no longer wish to share your information with another Participant, you may remove them from your list of friends. Groups or teams may be organized by the Sponsoring Customer for the purposes of challenges or contests. Being the member of a group or team does not give other members of that group or team the ability to see your data unless you friend them. Only group statistics (such as total group steps, average group daily steps, etc.) are used to determine the outcome of contests and challenges.
Your Boss
Your boss, employer, or other affiliates of your Sponsoring Customer organization do not have access to your daily activity data or other non-public information unless you authorize them by adding them as friends.
Third Party Services
You may choose to link your FitAWare data to 3rd party services, such as Google Health, or publish your data as a "Gadget" or "Widget" on other social networking platforms. If you choose to do so, be aware that information you share with 3rd party services is no longer under the control of AWare Technologies, and we cannot guarantee the privacy or security of non-public data provided to 3rd parties. Please make sure you read and understand the privacy policy of any 3rd party service before linking your profile or publishing your activity data with that service. AWare Technologies does not collect non-public personal information about Participants from 3rd party sources, including Google Health.
Use of Non-Public Participant Information
We do not disclose any non-public information about our Participants, or former Participants, to anyone except as specified in this Privacy Policy, or as compelled by law. Authorized AWare Technologies employees may access non-public Participant information to provide support to Participants, to provide administrative support to Customers, for forensic purposes (to investigate problems or undesirable behavior), and for other purposes directly associated with delivering and improving our products and services. We restrict access to Participant non-public information to those AWare employees who need to know that information to provide our products and services. All of our operational and data processing systems are located in secure environments that provide reasonable protection from unauthorized access by third parties.
Retention of Data
We retain your non-public Participant information for as long as you participate in the FitAWare program and for some time thereafter. If you withdraw from the FitAWare program we may continue to retain your non-public information for the purposes of historical reporting to the Sponsoring Customer (only aggregate statistics are reported) and for forensic and product development purposes. If you choose not to have your profile and activity data retained after you withdraw please contact support (support@awaretechs.com) and we will ensure that this data is removed from our database promptly after you withdraw from the FitAWare program.

Updates and Revisions to this Document
This is the AWare Technologies FitAWare Participant Privacy Policy, revision 060209-04 (June 4th, 2009). From time to time, AWare Technologies may update this privacy policy or other terms of service. When we do, we will make a good-faith effort to notify existing FitAWare Participants and Customers in advance using the email contact information we have on file. Please keep the contact information in your FitAWare Participant Profile up-to-date so that we may inform you of such changes in a timely fashion.
